1. Purpose of Privacy Policy

 

Your privacy is important to VIS.  Accordingly, VIS provides these policies so that you understand how VIS collects, uses and, in certain circumstances, discloses the information that you provide and/or that is automatically provided to VIS as a result of your visiting and using the Web site.  This Privacy Policy also explains the steps VIS has taken to secure your personal information.  Finally, this Privacy Policy explains your options regarding the collection, use and disclosure of your personal information.  By visiting the Web site, you accept the practices described in this Privacy Policy.  VIS is not responsible for the content or privacy practices on any third party web site that may be linked to or from the Web site.

2. How Information is Collected

 

VIS collects information from and about you in several different ways via the Web site.

 

  • Registration and Ordering. Before using certain parts of this Web site or ordering products, you must complete an online registration form.  During registration, you will be prompted to provide to VIS certain personal information, including, but not limited to, your name, shipping and billing address(es), phone number, email address, and credit card number.  In addition, VIS may also ask you for your country of residence and/or your organization’s country of operation, so VIS can comply with applicable laws and regulations, and for your gender.  This personal information is used for billing purposes, fulfilling your orders, and communicating with you about your order and the Web site, and for internal marketing purposes.  If VIS encounters a problem when processing your order, it will use your personal information to contact you.

 

  • User Submissions. Certain locations of the Web site permit you to enter your email address and other contact information to receive further information about VIS and to submit user content.  Your submissions for these purposes are completely voluntary, so you have a choice whether to participate and disclose information to VIS.  Should you choose to submit information in response to these requests, VIS may collect and use your name, email address, geographic location and other information submitted on the Web site to market VIS’ products.

 

  • Automatically Generated and Collected Information.  In addition to information that you volunteer as described above, the Web site utilizes technologies to collect information and track your user experience.  VIS will use this information to improve the Web site and user experience.  In addition, the Web site automatically recognizes the Internet URL from which you access this Web site and may also log your Internet protocol (“IP”) address (which may indicate the location of your computer on the Internet), Internet service provider, and date/time stamp for system administration, order verification, internal marketing, and system troubleshooting purposes.

 

  • Age.  VIS respects children’s privacy and will not knowingly or intentionally collect personal information from children under age 13.  As stated in the Terms of Use, you have represented and warranted that you are at least 18 years of age or using the Web site with the supervision of a parent or guardian.  If you are under the age of 13, do not, under any circumstance, submit any personal information to us and always rely on a parent or guardian to assist you.

 

Generally, VIS collects the above information to improve your experience at the Web site, to improve the products that VIS sells via the Web site and otherwise and to communicate with you regarding the Web site and VIS’ products.  In the event VIS uses your email address to communicate with you, it will provide you with the option to unsubscribe or opt out of future emails.  Please note that VIS may have to communicate with you about orders that you choose to place.  Accordingly, you cannot opt out of receiving order-related emails.

VIS will not sell, rent, trade, license or otherwise disclose your specific personal information or financial information to anyone, except that: (1) VIS uses third parties to perform specific functions on its behalf and it must disclose information to help those parties perform their services (for example, VIS would disclose your name, address and phone number to a commercial carrier such as Federal Express or UPS in order to deliver a product that you order); (2) VIS must disclose your name and credit card number and information to financial services and credit card processing companies in order to process your orders; (3) VIS may be required to disclose such information in response to a legal process, order or investigation (for example, a subpoena or court order); (4) VIS may disclose personal information where disclosure is necessary to protect its legal rights or to protect itself or others (for example, in order to reduce the risk of fraud or illegal activities); and (5) VIS may acquire, merge with or be acquired by another company or it might sell some or all of its assets, and, in such a case, VIS may disclose your personal information to another company.  VIS may sell, rent, trade, license, use and disclose non-personal information and aggregate information, so long as such information does not personally identify you or any user.

3. Security

The Web site incorporates physical, electronic, and administrative procedures to safeguard the confidentiality of your personal information.  While VIS believes that it uses industry-standard precautions to safeguard your personal information, as is the case with all web sites, it cannot guarantee complete security.

4. Opt Out and Corrections

This Privacy Policy applies only to information collected via the Web site and does not apply to information collected offline (for example, via phone calls and/or fax orders).  VIS may modify or supplement this Privacy Policy at any time without notification to you.  The current version of this Privacy Policy will be posted to www.cataractsurgeryinformation.com.  You are encouraged to review this Privacy Policy from time to time.

6. Disputes

This Privacy Policy is governed by the internal substantive laws of the State of Maine, without reference to its conflict of laws principles.  All disputes shall be resolved as described in VIS’ Terms of Use agreement.
